In consideration of being allowed access to the beach through the HI Point Montara Lighthouse Hostel property, the undersigned, acknowledge, appreciate, and agree that:
1. There are increased risks of use of the walkways, paths, stairs and grounds due to reduced staff and maintenance due to effects of Covid-19 on the operations of the facility and that these risks may be significant, including the potential for injury, including death
2. Access may be limited in time or dates due to lack of staff, repairs, or other circumstances.
3. I knowingly and freely assume all risks associated with the use of the property, both known and unknown, and assume full responsibility for my participation.
4. I willingly agree to comply with all of the following terms and conditions for access:
-- Agree to stay on any designated path
-- Agree to abide by an signage limiting times or dates of access
-- Agree not to bring anyone with me who has not signed a waiver
5. I, for myself and on behalf of my heirs, assignees, successors personal representatives, next of kin, or anyone that I bring on to the property hereby release, idemnify, and hold harmless, HI USA, the HI Point Montara Lighthouse Hostel, their officers, officials, agents, and/or employees, other participants, and any other owners and/or lessors of these facilities used, from and against any and all claims, demands, losses and liability arising from my/their use of the property to access the beach, including claims for negligence.
6. I knowingly understand that the use of the property is by the permission of HI USA and/or the HI Point Montara Lighthouse Hostel only; and such permission is subject to revocation by either HI USA or the HI Point Montara Lighthouse Hostel at any time in either HI USA or HI Point Montara Lighthouse Hostel's sole and absolute discretion.
7. I further agree to waive the right to a jury trial and acknowledge that any dispute shall be resolved by an arbitrator selected by the parties, or by an arbitrator assigned by the local office of the American Arbitration Association if the parties cannot agree upon the selection of an arbitrator. The decision of the arbitrator shall be final and binding upon the parties in a court of law.
I have read this release and assumption of risk agreement, fully understand its terms, understand that I have given up certain rights and sign it freely and voluntarily.
